Article III Project (A3P) founder and President Mike Davis recently blasted the Department of Justice (DOJ) for not providing the latest footage of the Jan. 6 false flag riot in the Capitol. This evidence, he noted, would have proven the innocence of many defendants who are still languishing in jail.
Davis made these remarks during an appearance on “Bannon’s War Room,” where host Steve Bannon discussed the newly-released J6 footage shown by Fox News host Tucker Carlson. The “Tucker Carlson Tonight” host managed to obtain the videos courtesy of House Speaker Kevin McCarthy (R-CA), which feature more than 40,000 hours of security footage from the Capitol hidden for over two years.
“The Justice Department has an obligation under the Constitution to provide to defendants the exculpatory evidence – evidence that tends to show their innocence,” the A3P president told the former White House chief strategist. “And with these thousands and thousands of hours of Capitol surveillance videos, you have to ask: What did the Justice Department do to obtain these videos and how do they make these videos available to these J6 defense attorneys?”
Davis mentioned the Brady Rule that calls for prosecutors to turn over exculpatory evidence to defense attorneys, which the DOJ failed to do. He also stressed that it wasn’t fair for a defense attorney representing a client to go over thousands of hours of video footage, while the DOJ has an army of prosecutors and agents under the Federal Bureau of Investigation working on the case.
Bannon pointed out that Attorney General Merrick Garland, former House Speaker Nancy Pelosi (D-CA) and the rest of the House J6 Select Committee had access to this footage. However, they instead permitted the prosecution and imprisonment of Americans simply exercising their right to free speech.
While airing never-before-seen footage from the J6 riots, Carlson said these videos seem to dispel numerous narratives promoted by the mainstream media (MSM) and Democratic-controlled House J6 Select Committee. The most prominent figure included in the videos is Navy veteran Jacob Chansley, which MSM outlets branded as the “QAnon Shaman.”
Based on the videos Carlson aired, officers of the U.S. Capitol Police (USCP) were escorting Chansley around the building without incident. Chansley was later arrested and federally indicted for “knowingly entering or remaining in any restricted building or grounds without lawful authority, and with violent entry and disorderly conduct on Capitol grounds.” The J6 defendant was later convicted to almost four years in prison. According to Davis, the “QAnon Shaman” pleaded guilty back in September 2021. But the latest videos shown by Carlson only serve to bolster his supposed acquittal. The DOJ should have given Chansley’s lawyers the specific video and should not have prosecuted him for the charges he was indicted for, the A3P president added.
Bannon agreed, saying there is no jury of peers in America that would find Chansley guilty if they had seen the Capitol video footage.
