Philadelphia District Attorney (DA) Larry Krasner has sued Elon Musk over the X platform owner’s $1 million giveaway program to swing state voters.
Krasner, a progressive DA bankrolled by Hungarian globalist billionaire George Soros, filed a complaint on Oct. 28. In his motion filed Monday in the Philadelphia Court of Common Pleas, Krasner accused the Tesla CEO and America PAC – Musk’s political action committee (PAC) backing former President Donald Trump – of “running an illegal lottery” in both the city and throughout the state of Pennsylvania.
According to Big League Politics, Krasner’s case is centered around the state’s lottery and consumer protection laws. He accused Musk of noncompliance with the state’s requirement for lottery operators. Under the Philadelphia law, lottery operators must publish “a complete set of lottery rules” and emphasize measures to safeguard the personal data of participants.
Krasner also claimed that the lottery rules are “deceptive” and the selection of winners could be rigged, writing: “Though Musk says that a winner’s selection is ‘random,’ that appears false because multiple winners that have been selected are individuals who have shown up at Trump rallies in Pennsylvania.” (Related: Elon Musk campaigning for Donald Trump in crucial swing state of Pennsylvania.)
“Running an illegal lottery and violating consumer protections is ample basis for an injunction and concluding that America PAC and Musk must be stopped, immediately, before the upcoming presidential election on Nov. 5. That is because America PAC and Musk hatched their illegal lottery scheme to influence voters in that election.”
The Oct. 28 lawsuit came on the heels of Musk announcing the eighth winner of America PAC’s $1 million giveaway in Lancaster, Pennsylvania. The South African-born Musk has remained firm in his commitment to reward registered voters in seven battleground states every day until Nov. 5, when Americans head to polling places to cast their votes.
“For participants to be eligible to participate in the giveaway, they have to sign a petition on the PAC’s website confirming their support for the First and Second Amendment of the U.S. Constitution,” wrote Jose Alberto Nino of Big League Politics. He added that while potential participants must be registered to vote per the online petition form, they can opt not to vote on Election Day.
But on Thursday, Oct. 31, Judge Angelo Foglietta of the Common Pleas Court said he wouldn’t immediately move forward with Krasner’s lawsuit. In a hearing that day, Foglietta explained that the lawsuit would be on hold while a federal court considers whether to take up the case.
The following day, a federal judge ruled that the case should be heard in state court. U.S. District Judge Gerald Pappert, a former Pennsylvania attorney general appointed by former President Barack Obama, issued the Friday ruling. This essentially returned the case to Foglietta’s desk, the Associated Press reported.
Musk meanwhile argued in a separate filing that the case belonged in federal court as it involves claims of federal election interference. The owner of the X platform also said the DA’s legal action also “raises questions of free speech rights,” per Reuters.
“Musk’s bid to move the case frees him to continue the giveaway because the matter likely won’t be resolved until after [the Nov. 5] election,” the news outlet pointed out.
But for Nino, the progressive Philadelphia DA’s complaint against Musk appears to be a last-ditch attempt to block the incoming red wave.
“Democrats know that their goose is cooked next week during the general election, so they’re pulling every trick in the book to try to prevent Trump and Republican candidates from winning,” he wrote. “That’s how things are breaking down in Clown World USA.”
