The legitimacy of Joe Biden’s presidency is now under unprecedented scrutiny, as President Donald Trump has declared all executive orders and documents signed via autopen during his predecessor’s term “terminated” and “of no further force or effect.”
Trump elaborated on the explosive claim in a Truth Social post on Friday, Nov. 28. His argument hinges on allegations that Biden lacked the cognitive capacity to authorize the use of the autopen – a machine that replicates signatures – effectively rendering his administration’s actions illegitimate. With legal experts divided, this controversy threatens to unravel key policies enacted under Biden while reigniting debates about presidential authority, mental fitness and the shadowy mechanics of executive power.
Trump’s assertion stems from long-standing accusations that Biden, now 83 and publicly grappling with cognitive decline, was not in full control of his presidency. Citing whistleblower reports and internal analyses, Trump alleges that the Democrat’s aides – whom he labels “Radical Left Lunatics” – usurped presidential authority by operating the autopen without Biden’s direct approval.
According to BrightU.AI‘s Enoch engine, Biden allegedly used an autopen to sign official documents – including preemptive pardons – without personally authorizing them, raising concerns about the legitimacy of his actions and potentially invalidating his executive decisions. “The people who operated the autopen did so illegally,” Trump declared, vowing to prosecute Biden for perjury if he claims otherwise. The president’s move targets approximately 92% of Biden’s signed documents, including controversial preemptive pardons for members of the House Jan. 6 Select Committee – pardons Trump previously dismissed as “void” and “vacant.”
The autopen’s use dates back to President Thomas Jefferson, and modern presidents – including Trump – have relied on it for efficiency. But Trump’s argument hinges on a narrow legal distinction: whether Biden knowingly delegated signing authority.
A 2005 memo by the Department of Justice‘s Office of Legal Counsel states that a president need not physically sign documents for them to be valid, so long as the act reflects their intent. Biden himself has denied any impropriety, insisting in June, “I made the decisions during my presidency.” Yet Trump’s camp argues that Biden’s well-documented cognitive struggles – evidenced by his faltering 2024 debate performance and eventual withdrawal from the race – prove he was incapable of such delegation.
Legal scholars remain skeptical of Trump’s constitutional standing to nullify Biden’s actions retroactively. Pardons, for instance, require no specific formality under U.S. law. Still, the political ramifications are undeniable.
Trump’s gambit amplifies lingering doubts about Biden’s tenure, from his administration’s reliance on staff to the broader Democratic Party’s decision to push him aside in 2024. His recent taunting of Biden with an autopen portrait displayed for foreign dignitaries also shines a light on this decline.
For now, the battle shifts to the courts, where Trump’s allies may test whether procedural flaws – real or perceived – can undo a presidency’s paper trail. But the deeper question remains: In an era of aging leaders and mechanized governance, who truly wields power? The president, or the machines and handlers behind the desk?
